Welcome to NC Freedom Fest Inc. (“we,” “us,” or “our”).NC Freedom Fest Inc. is a registered 501(c)(3) non-profit organization dedicated to honoring military personnel, veterans, and first responders.

These Terms of Service (“Terms”) govern your use of our website located at (the “Site”) and your participation in our annual event, vendor applications, volunteer programs, and online donations.

By accessing our Site or participating in NC Freedom Fest activities, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Site or services.

1. Use of the Website

  • Eligibility: By using this Site, you confirm that you are at least 18 years old or are accessing the Site under the supervision of a parent or guardian.

  • >Permitted Use: The Site is provided for informational purposes regarding our annual festival, vendor registration, volunteer coordination, sponsorships, and charitable donations.

  • Prohibited Conduct: You agree not to misuse the Site, attempt unauthorized access to our systems, transmit malicious software, or collect user data without explicit consent.

2. Donations & Financial Transactions

  • Charitable Status: NC Freedom Fest Inc. is an IRS-recognized 501(c)(3) tax-exempt public charity. Financial contributions made to NC Freedom Fest Inc. are tax-deductible to the extent allowed by law.

  • Payment Security: All online monetary donations, sponsorship payments, and vendor application fees are processed securely through PCI-compliant third-party payment gateways. We do not store sensitive payment card details on our servers.

  • Refund Policy: All monetary donations and contributions made to NC Freedom Fest Inc. are non-refundable. Vendor fees and sponsorship payments are subject to specific vendor/sponsor agreement terms provided upon application.

3. Vendors and Exhibitors

Vendors applying to participate in NC Freedom Fest must adhere to the following rules:

  • Application & Approval: Submitting an application does not guarantee booth placement. NC Freedom Fest reserves the right to approve or reject any vendor application at its sole discretion.

  • Prohibited Items & Vendors: Direct sales, flea market items, political booths, and unapproved commercial goods are strictly prohibited.

  • Taxes & Compliance: Vendors are solely responsible for collecting and remitting applicable sales tax to the North Carolina Department of Revenue.

  • Setup & Operations: Approved vendors are provided designated space (e.g., 10×10) and must supply their own tents, tables, chairs, and power sources unless otherwise specified.

4. Volunteer Terms & Release of Liability

  • Volunteer Expectations: Volunteers agree to represent NC Freedom Fest professionally and adhere to code-of-conduct guidelines provided during onboarding.

  • Liability Release: By volunteering with NC Freedom Fest Inc., you acknowledge that festival operations may involve physical labor, active event crowds, and outdoor environments. To the maximum extent permitted by law, volunteers agree to release NC Freedom Fest Inc., its Board of Directors, event partners, and municipal authorities (including the City of Goldsboro) from liability for accidental injury or loss sustained during volunteer service, except in cases of gross negligence.

5. Media, Photography & Public Likeness

NC Freedom Fest is a public, community event. By attending the festival or participating in activities hosted on public grounds (e.g., Downtown Goldsboro):

  • Media Recording: You acknowledge that you may be photographed, videotaped, or recorded by official event photographers, press partners, or attendees.

  • Promotional Use: You grant NC Freedom Fest Inc. the right to use your visual likeness, voice, or photograph in event marketing, social media content, website media, and annual reports to promote our charitable mission without financial compensation.

6. Intellectual Property

All content on the Site—including logos, graphics, text, event branding, and website design—is owned by NC Freedom Fest Inc. or used with permission. You may not reproduce, distribute, or create derivative works from any Site content without prior written authorization from NC Freedom Fest Inc.

7. Third-Party Links & Services

Our Site may contain links to external third-party websites (such as social media platforms, municipal sites, or payment gateways). NC Freedom Fest Inc. is not responsible for the content, privacy policies, or practices of third-party websites.

8. Disclaimer of Warranties & Limitation of Liability

  • “As Is” Basis: The Site and all information contained herein are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

  • Limitation of Liability: To the fullest extent permitted by law, NC Freedom Fest Inc., its officers, directors, volunteers, and agents shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Site or attendance at the festival.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any legal action arising under these Terms shall be filed in state or federal courts located in Wayne County, North Carolina.

We reserve the right to modify these Terms of Service at any time. Any updates will be posted on this page with an updated “Last Updated” date. Continued use of the Site or participation in event activities constitutes acceptance of the revised Terms.
